Islamabad: In the Judicial Complex vandalism case, the Anti-Terrorism Court Islamabad has confirmed the bail for Ali Nawaz Awan, Shibli Faraz, Umar Ayub, Umar Sultan, and Colonel (R) Asim.
Judge Tahir Abbas Supra of the Anti-Terrorism Court conducted the hearing. PTI lawyer Babar Awan and other lawyers appeared in court, along with Umar Ayub, Shibli Faraz, Amjad Niazi, Ali Nawaz Awan, and other PTI activists.
Lawyer Babar Awan requested that the court decide on the bail applications of those who were present, as some defendants could not attend the hearing.
Judge Tahir Abbas Supra inquired about Ali Amin Gandapur’s absence and whether there was any information about his appearance.
PTI lawyers responded that they would confirm and inform the court.
Babar Awan stated that Umar Ayub had to appear before a JIT in Lahore.
Judge Tahir Abbas Supra remarked that all defendants are in the same position; if bail requests are denied, they will be denied together.
The court will decide on all applications simultaneously.
Babar Awan argued that under Section 497, once a defendant surrenders before the court, they are entitled to bail, referencing past cases where PTI founder and Asad Umar’s bail requests were also granted by this court.
Judge Tahir Abbas Supra asked if there was any precedent where bail applications were not heard after a person was declared a proclaimed offender.
The court is still considering bail requests even after they were withdrawn.
Ali Amin Gandapur’s lawyer, Raja Zahoor, appeared in court and filed a request for exemption from attendance for the KP Chief Minister.
Raja Zahoor Advocate mentioned that Ali Amin Gandapur was in Kurram, where the situation is deteriorating.
Judge Tahir Abbas Supra directed PTI lawyers to provide the court with references to judicial decisions mentioned.
The court adjourned the hearing until September 4 due to Ali Amin Gandapur’s absence.
