Islamabad: The Islamabad High Court has reserved its decision on the petition requesting the formation of a judicial commission to investigate the murder of Arshad Sharif.
Chief Justice of Islamabad High Court, Justice Aamer Farooq, presided over the hearing. The Attorney General appeared in court.
During the hearing, the Attorney General informed the court that an agreement with the Kenyan government was pending.
He mentioned that limited access was initially granted by the Kenyan government, based on which a fact-finding report was prepared.
However, when the report was made public, the Kenyan government expressed displeasure and revoked access.
The Attorney General further explained that after the general elections in Kenya, the report was completed.
The draft agreement has been approved by the cabinet and will now be sent to Kenya. In relation to Arshad Sharif’s case, two Pakistanis have been investigated.
The Chief Justice remarked that the petition is concerning the judicial commission and inquired about Pakistan’s stance on whether an agreement had been made.
The Attorney General responded that a five-member bench of the Supreme Court has already been formed and will hear the case after the summer break.
The Chief Justice questioned whether a judicial commission formed in Pakistan could conduct investigations in Kenya, noting that Kenyan authorities are not obligated to appear before the commission.
The Attorney General replied that even after the agreement with Kenya, there would still be challenges.
After hearing the arguments, the court reserved its decision on the petition for the formation of a judicial commission.
